Short version: all sales are final — we do not offer refunds. You can cancel anytime; cancellation stops the next renewal and you keep access until the end of the period you have already paid for.
1. Scope
This policy applies to all PocketPhantom subscriptions purchased through our website and payment processor (Stripe): monthly or annual, alone or per seat for a team. PocketPhantom is a paid software subscription (the web app and the included AI) operated by PocketPhantom (based in Switzerland; not registered for VAT). It supplements our Terms of Service and is governed by Swiss law, without prejudice to the mandatory consumer-protection provisions of your country of residence.
2. No refunds
PocketPhantom is sold on a recurring subscription basis and is delivered as a digital product that you can use immediately. All payments are final and non-refundable, whether for the current period or any past period, and whether or not you used the Service. We do not provide pro-rata refunds for time remaining after a cancellation. A move to a smaller plan, or from annual to monthly billing, applies at the end of the current billing period; until then you keep your current plan, and nothing is refunded or credited for the change. This is consistent with the billing, cancellation and no-refund terms in our Terms of Service (sections 10 to 12). Unused included AI in a period is not refunded either.
If we choose to issue a refund anyway, on a discretionary, goodwill basis and without obligation, any such refund is net of non-recoverable payment-processing fees (for example, Stripe transaction fees that Stripe does not return to us).
3. Cancelling your subscription
You may cancel at any time, with no cancellation fee. Logged in, you manage and cancel your subscription in Settings › Billing. Without logging in, use the Manage subscription page, linked in the footer of this website. When you cancel:
- your subscription does not renew at the end of the current billing period;
- you keep full access until that period ends;
- no further charges are made.
4. Termination
If we suspend or close your account, for example after a refund, a duplicate purchase, or a violation of our Terms of Service, the subscription associated with it is automatically cancelled and your access to the Service ends. No further charges are made after that cancellation. This is the counterpart to the suspension and termination rights in our Terms of Service (section 15) and does not, by itself, create any right to a refund of amounts already paid.
5. Digital service & right of withdrawal
PocketPhantom is digital content and a digital service that is supplied to you immediately on purchase. On Stripe's checkout page you tick a box in which you expressly request that performance begin at once and acknowledge that, once it has, you lose any 14-day right of withdrawal for the current period. This refund policy is written to match that consent.
For customers in the EU/EEA, this reflects the digital-content exception in Article 16(m) of the Consumer Rights Directive (2011/83/EU): the right of withdrawal does not apply to the supply of digital content not on a tangible medium once performance has begun with your prior express consent and your acknowledgement that you thereby lose the right of withdrawal. Equivalent exceptions apply under many national implementations and comparable consumer-protection regimes.
Under Swiss law, the limited statutory right of revocation for distance and off-premises contracts (Articles 40a et seq. of the Swiss Code of Obligations) does not extend a general cooling-off right to online purchases of digital services of this kind, so no such right needs to be waived.
Mandatory consumer-protection provisions of your country of residence that cannot be waived remain unaffected, and nothing in this section limits any such non-waivable statutory right.
6. Free trials & failed payments
If a free trial or promotional period is offered, you can cancel before it ends to avoid being charged. If a renewal payment fails, your access may be paused or the subscription cancelled; resuming requires a successful payment.
7. Billing errors
If you believe you were charged in error (for example, a duplicate charge or a charge after a confirmed cancellation), contact us within 14 days and we will investigate and correct genuine billing mistakes. This is separate from the no-refund policy for valid charges.
